Renewing the work permit is essential for both employers and migrant workers to maintain legal employment in Thailand. The renewal process includes:

Check Expiry Date: Begin the renewal process at least 60 days before the expiry date.

 

Prepare Required Documents: These include the current work permit, passport (valid for at least six months), and other necessary documents.

 

Submit Renewal Request: Submit the renewal request for the work permit to the Provincial Employment Office or the Department of Employment in Bangkok.

 

Note: The work permit can be renewed for two years at a time and can be renewed twice, allowing a total employment period of four years.

The migrant worker’s visa must also be renewed along with the work permit to ensure legal residency and employment in Thailand. The renewal process includes:

Check Visa Expiry Date: Begin the renewal process at least 30 days before the visa expires.

 

Prepare Required Documents: These include a passport valid for at least six months, the current work permit, and other necessary documents.

 

Submit Visa Renewal Request: Submit the renewal request to the Immigration Bureau in the area where the worker resides.

 

Note: The work visa can be renewed for two years, in conjunction with the work permit.

Adjusting a worker’s status includes applying for a new work permit or changing the type of visa to align with the worker’s employment and residency status in Thailand. This also includes applying for a new work permit for workers changing employers or starting a new job, and workers wishing to change their visa type from tourist to work visa. The preliminary process includes:

Prepare Required Documents: These include the passport, current work permit (if applicable), employment contract, and other necessary documents.

 

Submit Status Change Request: Submit the request at the Employment Office or Immigration Office, depending on the type of status change.

Pink Card Application

The Pink Card is an identification card issued to migrant workers temporarily authorised to work in Thailand. The renewal or status adjustment of the Pink Card involves:

Check Expiry Date: Begin the renewal or status update process before the expiry date.

 

Prepare Required Documents: These include the current Pink Card, passport, or other identification documents.

 

Submit Request at the Employment Office: Submit the request at the Employment Office in the worker’s area of residence.

Employer or workplace change

Migrant workers in Thailand must comply with legal regulations when changing employers or workplaces to maintain lawful employment and residency.
Valid Reasons for Changing Employers:

Employer Termination or Death: If the employer terminates the contract or passes away, the worker has the right to change employers.

 

Employer Violating Contract or Labour Laws: If the employer fails to pay wages or does not comply with Thai labour protection laws.

 

Employer Bankruptcy or Business Closure: If the employer’s business ceases operations due to financial difficulties.

 

Unsafe Working Conditions: If the workplace poses serious health or safety risks.

 

Employer Notification of Termination: The previous employer must notify the Employment Office within 15 days of the worker’s departure.

 

Submit Employer Change Request: The worker must find a new employer and submit an application to change employers at the Employment Office within 30 days of leaving the previous job.

Health checks and other documents

Health checks are mandatory for migrant workers in Thailand. Workers must undergo medical screening for restricted diseases under Thai law before applying for or renewing work permits.
Health Screening Covers Six Restricted Diseases Under the Immigration Act, B.E. 2522:

– Leprosy
– Dangerous Tuberculosis
– Elephantiasis
– Drug Addiction
– Syphilis (Stage 3)
– Mental Disorders that Impede Work

 

Note: Workers must undergo medical examinations at government-accredited hospitals or certified medical facilities. A doctor’s certificate will be issued to support work permit applications or renewals.
